The Non-Habitual Resident Status (NHR) is a special regime that offers a reduction in Personal Income Tax (IRS) for 10 years to new foreign residents (of any nationality) and to Portuguese citizens who have been emigrating for more than 5 years.
If during the 10-year period you have not benefited from the right to tax as a NHR in one or more years, you can benefit from the regime again until you have completed the 10 years, as long as you are considered resident in Portugal for tax purposes.
In order to become a resident in Portugal, it is necessary(Article 16(1) of the CIRS):
- Have stayed in Portuguese territory for more than 183 days, consecutive or interpolated, in a 12-month period beginning or ending in the year in question; or
- If you have been in Portugal for less than 183 days, you must have a dwelling that you can keep and use as your habitual residence.

The NHR regime is a right that is neither compulsory nor automatic. If the taxpayer is interested in taking advantage of this status, he must request it from the AT, thus exercising the option for the special regime. If you don't apply for NHR status, you will be taxed as a tax resident in Portugal under the general regime.
Despite the repeal of the tax regime for non-habitual residents, a much smaller regime was created, which we will refer to as a successor to the Statute for Non-Habitual Residents.

The IRS benefit consists of taxation at a special rate of 20% on net income from categories A and B earned in the context of these activities, for a period of 10 consecutive years from the year of registration as a resident in Portuguese territory.
